1. Acceptance of terms
By accessing or using Collectari (“the Service”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use the Service. We reserve the right to update these terms from time to time; your continued use of the Service after changes are posted constitutes acceptance of the revised terms.
2. Description of service
Collectari provides curated passport lists of items, experiences, or goals that users can explore, start, and track. The Service includes public discovery of collections, optional user accounts to save progress, public profiles, and related features. We may add, change, or discontinue features at our discretion.
3. Eligibility and account registration
You must be at least 13 years of age (or the minimum age in your jurisdiction to consent to use online services) to use the Service. To create an account, you must provide accurate information, including a valid email address and a unique public handle. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us promptly of any unauthorized use.
4. User conduct and acceptable use
You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Service. You must not: use the Service in any way that violates applicable laws; impersonate any person or entity; harass, abuse, or harm others; attempt to gain unauthorized access to the Service, other accounts, or related systems; use automated means (e.g. scrapers, bots) to access the Service without our permission; or interfere with or disrupt the Service or its infrastructure. We may suspend or terminate accounts that violate these terms.
5. Intellectual property
The Service and its content (including but not limited to design, text, graphics, logos, and software) are owned or licensed by us and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service or our content without our prior written consent. You retain ownership of content you submit (e.g. profile picture, handle), but you grant us a non-exclusive, royalty-free license to use, display, and process that content as needed to operate and improve the Service.
6. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Your use of the Service is at your sole risk. Passports and content on the Service are for informational and entertainment purposes; we do not guarantee accuracy or completeness of any collection or third-party content.
7. Limitation of liability
To the fullest extent permitted by law, Collectari and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or good will, arising from your use of or inability to use the Service. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us, if any, in the twelve months preceding the claim, or one hundred dollars (USD), whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
8. Indemnification
You agree to indemnify, defend, and hold harmless Collectari and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.
9. Termination
You may close your account at any time through the Service or by contacting us at support@collectari.com. We may suspend or terminate your access to the Service, with or without notice, for any reason, including breach of these terms. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (including disclaimers, limitation of liability, and indemnification) shall survive termination.
10. Changes to the service and terms
We may modify the Service or these Terms at any time. We will indicate the “Last updated” date at the top of these Terms when we make material changes. Continued use of the Service after such changes constitutes acceptance. If you do not agree to the new terms, you must stop using the Service. For significant changes, we may provide additional notice (e.g. by email or in-app notification) where appropriate.
11. General provisions
These Terms constitute the entire agreement between you and Collectari regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision does not waive that right or provision. These Terms are governed by the laws of the United States and the state in which we operate, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
